Όροι & Προϋποθέσεις

1. Η διάρκεια του Διαγωνισμού, που διεξάγεται με ανοιχτή συμμετοχή για όλους τους παρευρισκόμενους του WeTestAthens 2023, από την εταιρία Onelity Greece MIKE (εφεξής η «Διοργανώτρια), και βραβείο την έκπτωση σε εκπαιδευτικά προγράμματα για πιστοποιήσεις του οργανισμού ISTQB® που παρέχει η Onelity Greece, όπως αυτό ορίζεται παρακάτω, ορίζεται από τις 9:00 έως τις 18:00 την Παρασκευή 06 Οκτωβρίου 2023 (εφεξής η «Διάρκεια»).

Διευκρινίζεται ρητά ότι, πριν την έναρξη και μετά τη λήξη του Διαγωνισμού, ή μετά από τυχόν σύντμηση της χρονικής Διάρκειάς του, οι συμμετοχές δεν είναι πλέον δυνατές και οι ήδη γενόμενες κατά το διάστημα αυτό θεωρούνται αυτοδικαίως ανύπαρκτες και ουδέν επάγονται αποτέλεσμα, ούτε δεσμεύουν πλέον οποιονδήποτε, θεωρούμενες νομίμως ανακληθείσες και αυτοδικαίως ανύπαρκτες. Στην περίπτωση αυτή οι συμμετέχοντες με τη συμμετοχή τους στο Διαγωνισμό αποδέχονται ανέκκλητα ότι δεν αποκτούν δικαίωμα ή απαίτηση κατά της άνω εταιρίας, ούτε νομιμοποιούνται να ζητήσουν είτε τη συνέχιση του λήξαντος Διαγωνισμού, είτε την παράδοση του μη παραδοθέντος βραβείου, είτε οποιαδήποτε περαιτέρω αποζημίωση.

2. Δικαίωμα συμμετοχής στο Διαγωνισμό έχουν οι παρευρισκόμενοι στο WeTestAthens 2023, εφόσον συμπληρώσουν την ειδική φόρμα συμμετοχής και απαντήσουν στις ερωτήσεις του διαγωνισμού, όπως τους ζητηθεί. Σε κάθε περίπτωση, οι συμμετέχοντες θα είναι ηλικίας άνω των 18 ετών και θα συμμετάσχουν στο Διαγωνισμό βάσει της διαδικασίας που αναπτύσσεται αναλυτικά παρακάτω.
Καθένας, έχει δικαίωμα συμμετοχής μία μόνο φορά στο Διαγωνισμό.
Από το Διαγωνισμό εξαιρούνται οι εργαζόμενοι της Διοργανώτριας.

3. Η συμμετοχή στο Διαγωνισμό αυτό είναι δωρεάν. Απαραίτητη προϋπόθεση είναι προηγουμένως η αποδοχή των όρων του Διαγωνισμού, στον οποίο αναφέρονται και οι τηρούμενοι κανόνες και οι διατάξεις περί προσωπικών δεδομένων, πάντοτε στο πλαίσιο και τις προϋποθέσεις του Γενικού Κανονισμού Προστασίας Δεδομένων (GDPR) και του Ν. 4624/2019.

4. Από το διαγωνισμό θα αναδειχθούν τρεις (3) νικητές, στους οποίους θα διανεμηθεί ψηφιακά στην ηλεκτρονική διεύθυνση με την οποία συμμετείχαν στον διαγωνισμό, ανάλογα με τα αποτελέσματα του ερωτηματολογίου που θα κληθούν να συμπληρώσουν, ένα από τα βραβεία, όπως αυτά περιγράφονται παρακάτω.
Οι νικητές οφείλουν να επικοινωνήσουν με τη Διοργανώτρια εντός δέκα (10) εργάσιμων ημερών από την ημερομηνία που τους ανακοινώθηκαν τα αποτελέσματα του Διαγωνισμού. Σε περίπτωση μη ανταπόκρισής τους ή λανθασμένων στοιχείων επικοινωνίας, η συμμετοχή τους θεωρείται αυτοδικαίως άκυρη. Η Διοργανώτρια έχει τη δυνατότητα να αποφασίσει εάν θα διαθέσει το βραβείο ή όχι σε κάποιον άλλο συμμετέχοντα, με τους ίδιους όρους και προθεσμίες.

5. Οι συμμετέχοντες θα κληθούν να συμπληρώσουν ένα ερωτηματολόγιο με ερωτήσεις γενικού περιεχομένου σχετικά με το κομμάτι του ελέγχου λογισμικού, κατά τα πρότυπα του οργανισμού ISTQB®. Οι απαντήσεις θα καταγράφονται και θα ελέγχονται για την ορθότητά τους. Θα καταγράφεται ακόμη και ο χρόνος συμπλήρωσης του ερωτηματολογίου. Τρεις (3) νικητές θα αναδειχθούν από τους συμμετέχοντες, με κριτήριο το ποσοστό ορθών απαντήσεών τους. Σε περίπτωση ισοβαθμίας νικητής του εκάστοτε βραβείου θα ανακηρύσσεται όποιος από τους ισοβαθμούντες συμμετέχοντες έχει συμπληρώσει το ερωτηματολόγιο σε συντομότερο χρονικό διάστημα. Περαιτέρω περίπτωση ισοβαθμίας θα επιλύεται μέσω κλήρωσης, η οποία θα διεξαχθεί δημοσίως την ίδια ημέρα στο χώρο του WeTestAthens 2023.
Ερωτηματολόγια που χρονομετρούνται και υπερβαίνουν τα 15λεπτά μέχρι την υποβολή τους θα θεωρούνται αυτοδικαίως άκυρα. Τα 15 λεπτά ορίζονται ως ο ανώτατος χρόνος για τη συμπλήρωση του ερωτηματολογίου σε κάθε περίπτωση.

  • 1ο βραβείο: απονέμεται στον 1ο νικητή και παρέχει 100% έκπτωση σε ένα εκπαιδευτικό πρόγραμμα της επιλογής του νικητή, που παρέχει η Onelity Greece (συγκεκριμένα για τις πιστοποιήσεις: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB®Test Automation Engineer).
  • 2ο βραβείο: απονέμεται στον 2ο νικητή και παρέχει 50% έκπτωση σε ένα εκπαιδευτικό πρόγραμμα της επιλογής του νικητή, που παρέχει η Onelity Greece, (συγκεκριμένα για τις πιστοποιήσεις: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB®Test Automation Engineer).
  • 3ο βραβείο: απονέμεται στον 3ο νικητή και παρέχει 25% έκπτωση σε ένα εκπαιδευτικό πρόγραμμα της επιλογής του νικητή, που παρέχει η Onelity Greece, (συγκεκριμένα για τις πιστοποιήσεις: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB®Test Automation Engineer).

Ανεξαρτήτως κατάταξης, όλοι οι υπόλοιποι συμμετέχοντες, εκτός των νικητών, δικαιούνται έκπτωση 10% σε ένα εκπαιδευτικό πρόγραμμα της επιλογής τους που παρέχει η Onelity Greece, (συγκεκριμένα για τις πιστοποιήσεις: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB®Test Automation Engineer).

Τα βραβεία παρέχονται από την εταιρία Onelity Greece Μ.Ι.Κ.Ε.
Τα βραβεία είναι συνυφασμένα πάντοτε με επίσημο κατάλογο διδάκτρων του εκάστοτε έτους, σύμφωνα με την εμπορική πολιτική της εταιρείας.
Τα βραβεία είναι συγκεκριμένα, προσωπικά, και δύναται να χρησιμοποιηθούν από τρίτους (δικαιούχοι) με την έγγραφη συμφωνία του νικητή του βραβείου. Τα βραβεία δεν ανταλλάσσονται, ούτε δύναται να ζητηθεί η αντικατάστασή τους με άλλα, ή η εξαργύρωσή τους σε χρήμα σε οποιαδήποτε τιμή.
Προϋπόθεση για την αξιοποίηση των βραβείων σε μία δεδομένη χρονική περίοδο, είναι η δημιουργία τμήματος για τη συγκεκριμένη επιθυμητή πιστοποίηση του οργανισμού ISTQB®, από την εταιρία Onelity Greece με ελάχιστο αριθμό συμμετεχόντων στο τμήμα, 5 άτομα.
Οι νικητές (ή τρίτοι δικαιούχοι) μπορούν να αξιοποιήσουν το βραβείο τους έως και 12 μήνες μετά την ανακοίνωση των αποτελεσμάτων του Διαγωνισμού σε αυτούς.
Σε περίπτωση που το βραβείο δεν αξιοποιηθεί εντός του ανωτέρου χρονικού διαστήματος, η ισχύς του βραβείου παραγράφεται στη λήξη της και δεν αντικαθίσταται.

Τα προαναφερθέντα ποσοστά έκπτωσης δεν συνδυάζονται με άλλα πιθανά εκπτωτικά προνόμια.

6. Σύμφωνα με του κανόνες και τις διατάξεις περί προσωπικών δεδομένων στο πλαίσιο και τις προϋποθέσεις του Γενικού Κανονισμού Προστασίας Δεδομένων (GDPR) και του Ν. 4624/2019, τα στοιχεία που θα συλλεχθούν, θα χρησιμοποιηθούν αποκλειστικά για το διαγωνισμό αυτό και για την επικοινωνία με ηλεκτρονική αλληλογραφία για διαφημιστικούς σκοπούς. Τα στοιχεία που συλλέγονται μπορούν να δημοσιευτούν και σε τρίτα πρόσωπα εφόσον αυτό κρίνεται απαραίτητο και εξυπηρετεί τις ανάγκες του διαγωνισμού.
Για τη συμμετοχή στο διαγωνισμό απαιτείται η συμπλήρωση των πραγματικών στοιχείων του συμμετέχοντα. Συγκεκριμένα στην ειδική φόρμα συμμετοχής θα πρέπει να συμπληρωθούν το ονοματεπώνυμο ή ψευδώνυμο και η ηλεκτρονική διεύθυνση (e-mail). Tο ονοματεπώνυμο ή ψευδώνυμο  θα δημοσιεύoνται σε τρίτα πρόσωπα καθ’ όλη τη διάρκεια του διαγωνισμού μαζί και με τη βαθμολογία που θα επιτύχει ο συμμετέχοντας. Προαιρετικά θα πρέπει να συμπληρωθούν στοιχεία όπως, το τηλέφωνο επικοινωνίας, το όνομα της εταιρίας όπου εργάζεται ο συμμετέχων, η εργασιακή του προϋπηρεσία στον κλάδο και ο τίτλος της θέσης εργασίας του.
Η εγκυρότητα της συμμετοχής διασφαλίζεται με τη συμπλήρωση των υποχρεωτικών πεδίων της φόρμας συμμετοχής που συνοδεύει το Διαγωνισμό και την ορθή υποβολή της εγγραφής. Σε περίπτωση ελλιπούς ή ανακριβούς συμπληρώσεως των στοιχείων η Διοργανώτρια διατηρεί το δικαίωμα ακύρωσης της συμμετοχής στο Διαγωνισμό.

 

7. Τα αποτελέσματα του διαγωνισμού ανακοινώνονται εντός τριών (3) εργάσιμων ημερών από τη διενέργεια του διαγωνισμού. Οι νικητές θα ειδοποιούνται μέσω ηλεκτρονικής αλληλογραφίας (email) στα στοιχεία που έχουν συμπληρώσει στη φόρμα συμμετοχής με την οποία συμμετείχαν στο Διαγωνισμό. Οι νικητές θα ειδοποιηθούν για το βραβείο που κέρδισαν καθώς και τη διαδικασία εξαργύρωσής του.

8. Η συμμετοχή στο διαγωνισμό σημαίνει ανεπιφύλακτη αποδοχή όλων των παρόντων όρων συμμετοχής από τους συμμετέχοντες.

9. Προσωπικά Δεδομένα: Στο πλαίσιο του Διαγωνισμού η Διοργανώτρια θα τηρήσει αρχείο με τα ακόλουθα προσωπικά δεδομένα: ονοματεπώνυμο ή ψευδώνυμο, ηλεκτρονική διεύθυνση (email), τηλέφωνο επικοινωνίας, το όνομα της εταιρίας όπου εργάζεται ο συμμετέχων, η εργασιακή του προϋπηρεσία στον κλάδο, ο τίτλος της θέσης εργασίας του, η αναλυτική βαθμολογία και ο χρόνος συμπλήρωσης, καθώς και το ποσοστό επιτυχίας στις ερωτήσεις του Διαγωνισμού.
Η συμμετοχή στο Διαγωνισμό αποτελεί για κάθε συμμετέχοντα την ελεύθερη, ανεπιφύλακτη και σαφή δήλωση, έγκριση και συναίνεση του για την επεξεργασία των παραπάνω δεδομένων του και την τήρηση σχετικού αρχείου σύμφωνα με τους ισχύοντες κανονισμούς και αποκλειστικά για την εξυπηρέτηση του Διαγωνισμού και για την επικοινωνία με ηλεκτρονική αλληλογραφία για διαφημιστικούς σκοπούς.

10. Επεξεργασία προσωπικών δεδομένων-Δικαιώματα συμμετεχόντων
Η επεξεργασία των προσωπικών δεδομένων των συμμετεχόντων και των νικητών (ή/και επιλαχόντων) βασίζεται στην συγκατάθεσή τους, την οποία μπορούν να ανακαλέσουν ανά πάσα στιγμή ελεύθερα αποστέλλοντας μήνυμα ηλεκτρονικού ταχυδρομείου στην ηλεκτρονική διεύθυνση academy@onelity.com της Διοργανώτριας. Σε περίπτωση ανάκλησης της συγκατάθεσης πριν την εξαργύρωση του βραβείου η Διοργανώτρια δεν θα είναι σε θέση να επεξεργαστεί την συμμετοχή τους στο Διαγωνισμό και συνεπώς η συμμετοχή τους θα ακυρώνεται. Τυχόν ανάκληση της συγκατάθεσης εκ μέρους των συμμετεχόντων ή/και των νικητών (ή/και επιλαχόντων), δεν θίγει τη νομιμότητα της επεξεργασίας για το διάστημα πριν την ανάκληση. Αποδέκτες των προσωπικών δεδομένων των συμμετεχόντων και των νικητών, πέραν του ονοματεπωνύμου ή ψευδωνύμου και της βαθμολογίας στις ερωτήσεις του Διαγωνισμού, θα είναι μόνο οι αρμοδίως εξουσιοδοτημένοι εργαζόμενοι της Διοργανώτριας που είναι επιφορτισμένοι με καθήκοντα για τη διεξαγωγή του Διαγωνισμού και την διενέργεια της απαιτούμενης επικοινωνίας.

11. Εφαρμοστέο Δίκαιο – Δωσιδικία : Οι παρόντες όροι διέπονται και συμπληρώνονται από το ελληνικό δίκαιο. Κάθε διαφορά σχετικά με το Διαγωνισμό, που ενδέχεται να προκύψει στο μέλλον, υποβάλλεται στην αποκλειστική αρμοδιότητα των Δικαστηρίων της Θεσσαλονίκης.

12. Αποδοχή των όρων : Η συμμετοχή στον Διαγωνισμό συνιστά ανεπιφύλακτη αποδοχή του συνόλου των όρων του και συνεπάγεται τη συνακόλουθη παραίτηση από κάθε σχετική αξίωση έναντι της Διοργανώτριας.

Η Διοργανώτρια διατηρεί το δικαίωμα να τροποποιήσει οποιοδήποτε / οποιουσδήποτε όρο(-ους) του Διαγωνισμού.

Terms & Conditions 

1. The duration of the Contest organized by Onelity Greece SMPC (hereinafter the “Organizer”), which allows the open participation of all attendees of WeTestAthens 2023, offers as a prize discounts on training programs for ISTQB® certifications provided by Onelity Greece, as defined below. The duration of the Contest is set from 9:00 to 18:00 on Friday 06 October 2023 (hereinafter the “Duration”).

It is expressly stated that, before the start and after the end of the Contest, or after any shortening of its duration, entries are no longer possible and those already made during this period are automatically considered invalid and have no effect, nor do they bind anyone, being considered legally withdrawn and automatically invalid. In this case, by participating in the Contest, entrants irrevocably accept that they do not acquire any right or claim against the above mentioned company, nor are they entitled to claim either the continuation of the expired Contest, or the delivery of the undelivered prize, or any further compensation.

2. Those attending WeTestAthens 2023 are entitled to participate in the Contest, provided they fill in the entry form and answer the Contest’s questions as requested. In any case, participants will be over 18 years of age and will participate in the Contest on the basis of the procedure described below.

Each participant is eligible to participate to the Contest only once.

Employees of the Organizer are excluded from the Contest.

3. The participation in this Contest is free of charge. A prerequisite is the prior acceptance of the terms of the Contest, which also refer to the rules and provisions on personal data, always in the context and conditions of the General Data Protection Regulation (GDPR) and Law 4624/2019.

4. Three (3) winners will be selected from the Contest and will be awarded one of the prizes as described below, depending on the results (scores) in the questionnaire they will be asked to complete. The prize will be digitally distributed to the email address the winners used to participate in the Contest.

Winners must contact the Organizer within ten (10) working days starting from the day they are notified of the results of the Contest. In the event of non-response or incorrect contact details, their entry will be deemed invalid. The Organizer may decide whether or not to make the prize available to another participant, subject to the same conditions and deadlines.

5. Participants will be asked to fill in a questionnaire with general questions on software testing, according to the ISTQB® standards. The answers will be recorded and checked. The time taken to complete the questionnaire will also be recorded. Three (3) winners will be selected from the participants, based on the percentage of correct answers. In the event of a tie, the winner of each prize will be the participant who has completed the questionnaire in the shortest time. In the event of a further tie, a draw will be held in public on the same day at the WeTestAthens 2023 venue.

Questionnaires that are timed and exceed 15 minutes until submission will be automatically considered invalid. The 15 minutes is defined as the maximum time for completing the questionnaire in each case.

  • 1st prize: awarded to the 1st winner, provides a 100% discount on a training course of the winner’s choice, provided by Onelity Greece (specifically for the certifications ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB® Test Automation Engineer).
  • 2nd prize: awarded to the 2nd winner, provides a 50% discount on a training program of the winner’s choice, provided by Onelity Greece, (specifically for the certifications: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB® Test Automation Engineer).
  • 3rd prize: awarded to the 3rd winner, provides a 25% discount on a training program of the winner’s choice, provided by Onelity Greece, (specifically for the certifications: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB® Test Automation Engineer).

Regardless of the ranking, all other participants, except the winners, are entitled to a 10% discount on a training program of their choice provided by Onelity Greece, (specifically for the certifications: ISTQB® Foundation, ISTQB® Agile Tester, ISTQB® Test Manager, ISTQB®Test Automation Engineer).

The prizes are provided by Onelity Greece SMPC.

The prizes are aligned with the official list of tuition fees of the certain year, in accordance with the company’s commercial policy.

The prizes are specific, personal, and may be used by third parties (beneficiaries) with the written consent of the prize winner. Prizes are not exchangeable, nor may they be substituted for others, or redeemed for cash at any price.

A prerequisite for the utilization of the prizes in a given period of time, is the creation of a training group for the specific desired certification of the ISTQB® organization, by the company Onelity Greece with a minimum number of five (5) participants.

The winners (or third party beneficiaries) can use their prize within 12 months after the announcement of the results of the Contest to them.

If the prize is not used within the above mentioned period, the prize will expire at the end of the period and will not be replaced.

The above mentioned discount rates are not combined with other possible discount benefits.

6. In accordance with the rules and provisions on personal data in the context and conditions of the General Data Protection Regulation (GDPR) and Law 4624/2019, the data collected will be used exclusively for this Contest and for the communication by e-mail for promotional purposes. The data collected may also be published to third parties if this is deemed necessary and serves the needs of the Contest.

Participation in the Contest requires the filling in of the participant’s data in the special entry form. In particular, the full name or pseudonym and the e-mail address must be filled in on the special entry form. The full name or pseudonym will be published to third parties throughout the Contest, together with the score achieved by the participant. Optionally, information such as contact telephone number, name of the company where the participant works, work experience in the industry and the title of the job can be filled in.

The validity of the entry is ensured by completing the mandatory fields of the entry form that accompanies the Contest and the correct submission of the registration. In the event of incomplete or inaccurate completion of the data, the Organizer reserves the right to cancel the entry to the Contest.

7. The results of the Contest are announced within three (3) working days from the date of the Contest. The winners will be notified by email to the details they have filled in on the special entry form. Winners will be notified of the prize they have won and the procedure for redeeming it.

8. The participation in the Contest implies unconditional acceptance of all these terms and conditions by the participants.

9. Personal Data: In the context of the Contest, the Organizer will keep a record of the following personal data: full name or pseudonym, e-mail address (email), contact telephone number, the name of the company where the participant works, his/her work experience in the industry, the title of his/her job, the detailed score and time of completion, as well as the success rate in the questions of the Contest.

Participation in the Contest constitutes for each participant a free, unconditional and unequivocal declaration, approval and consent to the processing of the above data and the keeping of relevant records in accordance with the applicable regulations and solely for the purpose of the Contest and for the communication by e-mail for promotional purposes.

10. Processing of personal data-Rights of participants
The processing of personal data of participants and winners (and/or runners-up) is based on their consent, which they can freely withdraw at any time by sending an email to the Organizer’s email address academy@onelity.com. In the event that consent is withdrawn before the prize is redeemed, the Organizer will not be able to process their entry into the Contest and their entry will therefore be cancelled. Any withdrawal of consent by entrants and/or winners (and/or runners-up) will not affect the lawfulness of the processing for the period prior to the withdrawal. The recipients of the personal data of participants and winners, other than the name or pseudonym and the score in the questions of the Contest, will only be the duly authorized employees of the Organizer who are entrusted with tasks for the conduct of the Contest and the carrying out of the required communication.

11. Applicable Law – Jurisdiction: These terms are governed and supplemented by Greek law. Any dispute relating to the Contest, which may arise in the future, shall be submitted to the exclusive jurisdiction of the Courts of Thessaloniki.

12. Acceptance of the terms: The participation in the Contest constitutes unconditional acceptance of all its terms and implies the consequent waiver of any relevant claim against the Organizer.

The Organizer reserves the right to modify any term(s) of the Contest.

Applicable law

  • The data subject withdraws consent to which the processing is based according to point (a) of Article 6(1) of the GDPR, or point (a) of Article 9(2) of the GDPR, and where there is no other legal ground for the processing.
  • The data subject objects to the processing pursuant to Article 21(1) of the GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) of the GDPR.

Where the controller has made personal data public and is obliged pursuant to Article 17(1) to erase the personal data, the controller, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. An employees of the Onelity MEPE will arrange the necessary measures in individual cases.

e) Right of restriction of processing

Each data subject shall have the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies:

  • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
  • The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead the restriction of their use instead.
  • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
  • The data subject has objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

If one of the aforementioned conditions is met, and a data subject wishes to request the restriction of the processing of personal data stored by the Onelity MEPE, he or she may at any time contact any employee of the controller. The employee of the Onelity MEPE will arrange the restriction of the processing.

f) Right to data portability

Each data subject shall have the right granted by the European legislator, to receive the personal data concerning him or her, which was provided to a controller, in a structured, commonly used and machine-readable format. Furthermore, in exercising his or her right to data portability pursuant to Article 20(1) of the GDPR, the data subject shall have the right to have personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others.

In order to assert the right to data portability, the data subject may at any time contact any employee of the Onelity MEPE.

g) Right to object

Each data subject shall have the right granted by the European legislator to object, on grounds relating to his or her particular situation, at any time, to processing of personal data concerning him or her, which is based on point (e) or (f) of Article 6(1) of the GDPR. This also applies to profiling based on these provisions.

The Onelity MEPE shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims.

If the Onelity MEPE processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to the Onelity MEPE to the processing for direct marketing purposes, the Onelity MEPE will no longer process the personal data for these purposes.

In addition, the data subject has the right, on grounds relating to his or her particular situation, to object to processing of personal data concerning him or her by the Onelity MEPE for scientific or historical research purposes, or for statistical purposes pursuant to Article 89(1) of the GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest.

In order to exercise the right to object, the data subject may contact any employee of the Onelity MEPE. In addition, the data subject is free in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to use his or her right to object by automated means using technical specifications.

h) Automated individual decision-making, including profiling

Each data subject shall have the right granted by the European legislator not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her, or similarly significantly affects him or her, as long as the decision (1) is not is necessary for entering into, or the performance of, a contract between the data subject and a data controller, or (2) is not authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is not based on the data subject’s explicit consent.
